Terms of Service

1. Acceptance of Terms

By accessing or using the Stacko Digital website at www.stackodigital.com or the Stacko WhatsApp Marketing Platform at app.stackodigital.com (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

These Terms constitute a legally binding agreement between you and Stacko Ventures LLP (“Stacko Digital,” “we,” “us,” or “our”), a company registered in India.

2. Description of Services

Stacko Digital provides:

  • A WhatsApp Marketing Platform enabling businesses to send and receive WhatsApp messages, manage contact lists, create and submit message templates, run broadcast campaigns, and manage customer conversations via the Meta WhatsApp Business API
  • A multi-client agency dashboard allowing marketing agencies to manage WhatsApp operations for multiple client businesses
  • Digital marketing and growth consulting services for SMBs

Our platform operates as a WhatsApp Tech Provider and integrates with Meta’s WhatsApp Business API. Use of the WhatsApp features is subject to Meta’s WhatsApp Business Terms of Service in addition to these Terms.

3. Eligibility and Account Registration

  • You must be at least 18 years old and capable of forming a legally binding contract to use our Services
  • You must provide accurate, complete, and current information when registering an account
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account
  • You must notify us immediately at support@stackodigital.com of any unauthorised use of your account
  • One account per business entity; creating multiple accounts to circumvent limits is prohibited

4. WhatsApp Messaging — Acceptable Use

By using our WhatsApp messaging features, you agree to:

  • Obtain explicit opt-in consent from every contact before sending them WhatsApp messages through our platform
  • Honour opt-out requests immediately — remove any contact who replies “STOP” or otherwise unsubscribes from all future campaigns without delay
  • Comply with Meta’s WhatsApp Business Policy including permitted message categories and template guidelines
  • Not send spam, unsolicited bulk messages, misleading content, or messages to contacts who have not opted in
  • Not use our platform for illegal, harmful, abusive, or deceptive purposes
  • Maintain consent records and make them available upon request
  • Ensure all message templates submitted through our platform comply with Meta’s template approval guidelines

We reserve the right to suspend or terminate accounts that violate Meta’s policies or these Terms, and to report violations to Meta.

5. Prohibited Activities

You must not:

  • Use the Services to send spam, phishing messages, or any communication that violates applicable law
  • Attempt to gain unauthorised access to our systems, other accounts, or Meta’s infrastructure
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Resell or sublicense access to the platform without our express written permission
  • Upload malicious code, viruses, or any software intended to damage or disrupt the Services
  • Collect or harvest data from the platform beyond what is necessary for your own authorised use
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the platform in any way that violates Meta’s Platform Terms or WhatsApp Business Policy

6. Billing and Payment

  • Subscription fees are billed in advance on a monthly or annual basis as selected at signup
  • All fees are exclusive of applicable taxes (GST or other taxes as required by Indian law)
  • Payments are processed securely by our payment provider; we do not store card details
  • Failed payments may result in service suspension after reasonable notice
  • Refunds are not provided for partial months; you may cancel at any time and retain access until the end of your paid period
  • We reserve the right to change pricing with 30 days’ written notice to your registered email

7. Intellectual Property

All software, designs, logos, content, and technology comprising the Stacko Digital platform are owned by Stacko Ventures LLP and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond what is necessary to use the Services.

You retain ownership of all content and data you upload to the platform. By uploading content, you grant us a limited licence to process and transmit that content solely for the purpose of providing the Services to you.

8. Termination

  • You may cancel your account at any time from your account settings or by contacting support@stackodigital.com
  • We may suspend or terminate your account immediately if you breach these Terms, violate Meta’s policies, or engage in prohibited activities
  • Upon termination, your access to the platform ceases and your data will be deleted in accordance with our Privacy Policy
  • Sections 5, 7, 9, 10, and 11 survive termination

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses.

Our platform relies on Meta’s WhatsApp Business API. We are not responsible for outages, policy changes, or restrictions imposed by Meta that affect the availability or functionality of our Services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Stacko Ventures LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Services.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify you by email or in-platform notice at least 14 days before changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of competent courts in India.
